This Intellectual Property Policy outlines how we handle claims of infringement, how intellectual property owners can report violations, and how Flupio sellers can respond if their listings or shops are affected by a report.
This policy is part of our Terms of Use and applies to all users of the Flupio marketplace.
Flupio is an online marketplace that connects buyers with independent sellers who manage their own shops, create their own policies, and are responsible for their inventory, shipping, and legal compliance. Flupio does not manufacture goods, hold inventory, or deliver products on behalf of sellers. All content listed on Flupio is uploaded by individual sellers, who are solely responsible for ensuring they have the necessary rights to sell their products and that they do not infringe on the intellectual property of others.
Flupio reserves the right to disable any listing, shop, or account that we believe violates our Terms of Use, including this Intellectual Property Policy or our Prohibited Items Policy. We may also take action against users who repeatedly violate intellectual property rights or abuse our reporting process.
While we strive to uphold intellectual property laws, Flupio does not provide legal advice or make legal determinations regarding disputes over intellectual property. We act in accordance with our policies when responding to reports of infringement.
If you believe that a listing on Flupio infringes on your intellectual property rights, you can submit a report. Flupio will review all claims that comply with our policies and may remove or disable access to the allegedly infringing content. When Flupio takes action on a report, we make reasonable efforts to notify the affected seller and provide relevant information.
To report a violation, please submit a request through email to support@dearnex.com. We may require additional verification, such as proof of ownership or authorisation from the rights holder, to process a claim. Flupio reserves the right to reject reports that are incomplete, fraudulent, or submitted in bad faith.
If your listing or shop has been affected by a report of infringement, you have the option to respond. If you believe that your content was removed in error, you may submit a counter notice. Flupio will review counter notices and, where applicable, share them with the original reporting party. Content may be reinstated unless the rights holder initiates legal action.
Flupio enforces a strict policy against repeated intellectual property violations. Sellers who receive multiple valid infringement reports may have their selling privileges restricted or their accounts suspended. If a seller attempts to open a new shop after an account has been terminated for infringement, we reserve the right to refuse service. These actions apply to all associated accounts of the affected seller.
Only the intellectual property owner or their authorised representative who originally submitted the claim may withdraw an infringement report. Withdrawals must clearly state that they are formal retractions and provide sufficient details, including the affected seller’s information and the reported listing URLs.
Once a withdrawal request is received, Flupio will review it and may reinstate the removed content. However, each case is evaluated individually, and a withdrawal does not guarantee that a seller’s account or listing will be restored.
